All documents ARS prepares including, BUT NOT LIMITED TO, preliminary notices, are done at customer’s request. These documents are prepared based on the information provided by the customer to ARS and ARS IS NOT responsible for the accuracy of the information provided by the customer.

Asset Research Services, Inc. assumes no responsibility for the errors of third party sources, changes in ownership of property that first appeared after the document preparation has taken place or by any and all public records sources including title companies, recorders offices, assessor’s offices, building permits, planning and zoning, etc., that do not keep their records up to date. In addition, ARS assumes no responsibility for errors, quality of service, or lack of record by the United States Postal Service and other document/mail delivery carries.

All document requests that lack a) complete project address, or b) complete customer information, or c) at least (3) working days until pre-lien expiration date, are subject to cancellation. Additionally for TX/TN/LA notices client must direct ARS to mail by 11am MST on the statute specified mail date.  ARS at its sole discretion may attempt to complete a late/incomplete Pre-Lien subject to Late or InComplete Surcharges AND IN ALL CASES WILL NOT BE HELD LIABLE FOR THE CONTENT THEREOF OR THE TIME FRAME IN WHICH IT IS SENT OUT. All Document Requests that contain more than one (1) Lot are subject to ‘Additional’ surcharges. Work submitted after 11am MST on a normal work day may be processed on the following work day.  ARS insures its Do-Research work to a maximum of ten thousand US dollars ($10,000) of the stated Estimated Cost project value and in all cases will not be held liable for all consequence due to missed client directives, confirmed docs, No-Research docs or docs containing information not received directly through its web site. All Confirmed data is assumed accurate and complete unless immediately notified otherwise and in writing. All notice information requires re-verification prior to filing a Lien or Stop Notice. LIENS EXPIRE: It is your responsibility to monitor associated Lien time frames. USPS Mail Service is not always dependable nor trackable: ARS can not be held liable for mail once it is deposited with the USPS nor for any interruptions in service not within it’s sole control.

Document requests submitted to ARS by noon on a normal work day may be received and processed by ARS on the following day. It is the customer’s responsibility to review each confirmation for accuracy and notify ARS immediately of any discrepancies. ARS will not be held LIABLE for missing documents in which the customer is unable to produce a “Confirmation and Data Received Verification Report” listing the document (or documents) in question. Reports generated by customer’s fax machine, email read receipts, or customer side web generated reports WILL NOT be accepted.

If a customer elects to file their own lien or stop notice, all information on the originating pre-lien notice MUST be re-verified. The possibility that information has changed since the original pre-lien was prepared warrants this additional step in ALL cases. If a customer elects to have ARS prepare and file a lien, re-verification will automatically be done by ARS prior to filing said lien. In addition, it is the customer’s responsibility to monitor associated lien time frames, allotting ARS ample time for re-verification and preparation.

Asset Research Services, Inc. will verify as much information as possible in the preparation of all documents and may require additional information from the customer to complete notice preparation. ARS at its sole discretion may choose to cancel a notice in which the customer or critical parties do not respond to requests for additional information.

Accounts become past due at 60 days and are automatically changed to STOP status. No proof of service or affidavits will be issued on past due accounts until the entire account balance is paid in full and customer’s check clears the bank. Bad check fees will be charged back to your account. Those customers who continually write bad checks will be put on a C. O. D. status.

Asset Research Services, Inc. reserves the right to refuse to work with clients who do not adhere to the terms and conditions above stated.
